Boom Application Update We are part of
the CCC - The Combined Chairperson's Committee , which was formed to
challenge the JRA's stance that it could steamroll
communities. As a result we
are kept up to date of any developments which may occur in this
regard and have clout with a large 'war' chest and the expertise of
Dukes Attorneys. The JRA has
acted 'ultra vires' ( beyond its authority ) because it has not
followed the guidelines that were promulgated and has been taken to
task in court. The current situation is that all closures are in a
state of limbo ! The JRA was procedurally incorrect by not calling
for a public meeting which should have been attended by the SAPS,
the community concerned, any interested parties and of course their
own officials. It would seem as
though it was logistically impossible to carry out this requirement
and thus where closures have been removed costs have been awarded
and the JRA has had to restore the closure's security. |

The reason being
that at best if the JRA carries out the requirement and a closure is
approved or if the appeal is upheld then within 2 years
re-application would occur together with the exorbitant costs
attached thereto. Furthermore the
JRA staff are reluctant to make any decisions as individuals can be
held liable in their personal capacity for any incorrect decisions
that are made. The longer this
drags on for the better! |
